What are the penalties?

While it’s against the law for adults to drive with a blood alcohol level of .08% in Florida, for drivers under 21, the legal limit is .02% or higher under Florida’s zero tolerance law. This means that if an underage driver is stopped by the police and found to have a BAL of .02% or higher, their license will be automatically suspended for 6 months.

This .02% limit was established so young drivers could not have a single drink and drive – and that was the whole idea. The driver’s license suspension can be increased if the driver’s BAL was over .05%, or if the driver had a BAC of .08%, they face the same penalties as an adult, which include:
